In compliance with the provisions of applicable regulations on personal data protection, we inform you that the personal data that USERS of our APPS may provide us with, either through the use of the APPS, or by sending an email to the address provided for this purpose or by any other means of communication, will be processed by MONKEY TAPS as Data Controller.
Personal data is considered to be any information that identifies or allows the identification of a natural person, such as name, surname, image, voice, postal address, email address, telephone number, official identity documents (tax identification number, national identity card, passport), etc. and/or that relates to a natural person, such as their circumstances, bank account, tastes, preferences, habits and behaviors, the products or services they will purchase, etc.
All personal data processed will be:
a) Provided by the data subject and/or authorized person through any means of communication, whether through:
- APPS, through forms and/or emails.
- The contracting of the SERVICES offered in the APPS.
This data may include (depending on the specific application):
- Name (optional).
- Gender (optional).
- Age (optional).
- Location (optional).
- Profession (optional).
- Images you upload (e.g. photos for editing, enhancement or AI generation).
- Biometric information derived from uploaded images (e.g. facial feature vectors), only when the specific APP requires this functionality and always with your prior consent.
- Information provided in queries or communications with support.
b) Those generated during the use of the APPS or derived from the above actions, such as:
- Images generated by the apps (e.g. enhanced photos or AI images).
- Information about your interaction with the application.
- Information about your subscription.
c) Information obtained through the study and research of the above data.
d) We also inform you that we automatically collect certain information when you visit, use, or browse the APPS. This information does not reveal your specific identity (such as your name or contact information) and is primarily necessary to maintain the security and operation of our APPS, as well as for our internal analysis and reporting.
The information we automatically collect when you use our APPS includes:
- Log and usage data. Log and usage data is service, diagnostic, usage, and performance-related information that our servers automatically collect when you access or use our APPS and that we record in log files. Depending on how you interact with MONKEY TAPS, this log data may include your IP address, device information, browser type and settings, and information about your activity on the APPS (such as timestamps associated with your usage, pages and files viewed, searches and other actions you take, such as the features you use), information about device events (such as system activity, error reports (sometimes called "crash dumps") and hardware configuration).
- Device data. We collect device data, such as information about your computer, phone, tablet, or other device you use to access the APPS. Depending on the device, this data may include information such as your IP address (or proxy server), device and APPS identification numbers, location, browser type, internet service provider or mobile operator, hardware model, operating system, and system configuration information. If you wish to modify our access or permissions, you can do so in your device settings.
- Location data. We collect location data, such as information about the location of your device, which may be accurate or inaccurate. The amount of information we collect depends on the type and configuration of the device you use to access the application. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can choose not to allow us to collect this information by denying access to it or by disabling the location setting on your device.
- Push notifications. We may send you push notifications about your account or certain features of the APPS. If you do not wish to receive these communications, you can disable them in your device settings.
Personal data will be processed by MONKEY TAPS as the Data Controller.
Personal data will be processed in accordance with the purposes described below and in accordance with the manner, legal basis and retention period described for each purpose:
a) Provision of the requested SERVICES
In order to provide the requested SERVICES, MONKEY TAPS will process the personal data of USERS who download and use the APPS. We use your personal data exclusively to enable you to use the APPS and to provide you with the SERVICES you have requested.
a.1) Personal data processed
The following data is used to provide our SERVICES through the APPS:
- USER identifiers (such as Apple ID) and mobile identifiers (such as IP address, device identifiers and custom identifiers that we generate to identify our USERS).
- Device information (such as device model, device type, operating system version, device language, device name, and region).
- Subscription information: data necessary to manage access to free or paid plans.- Information about your interaction with the application.
- Images you upload, as well as images generated by the APPS (e.g. enhanced photos or AI images). To do this, the application needs access to your device's camera and/or library, which you must expressly authorize via your system's pop-up window. Until you decide to upload images, they do not leave your device or get stored on our servers. You can revoke the permission granted at any time through your mobile device settings.
a.2) Purpose of processing
The aforementioned data is used exclusively to enable the USER to access and use the functionalities of the APPS and to provide the expressly requested SERVICES.
In particular, the SERVICES include:
- The generation of customized visual designs for patios, gardens, interior areas or other physical spaces based on images sent by USERS.
- The modification or creation of personalized images of people, including changes to hair, beards and clothing.
- The generation of conceptual or visual designs of toys and other customized objects derived from images or ideas provided by the USER.
a.3) Legal basis
The legal basis for the processing of your personal data is the execution of the contract you have entered into with MONKEY TAPS, to the extent necessary to provide you with the requested SERVICES.
a.4) Use of AI providers. To provide these SERVICES, we use AI technology providers such as ChatGPT, DeepSeek and Flux-Kontext through Replicate. These providers help process the images and texts you send to generate the requested results, always respecting the privacy and security of your data at . These providers are used for the following purposes:
- Replicate (Flux-Kontext): processes images sent by the USER that do not contain biometric data (e.g. photographs of gardens, interiors, toys or other objects) to generate personalized visual results. The data is processed in real time and deleted at the end of the active session, without permanent storage. In APPS that incorporate specific hairstyle and beard transformation features, Replicate may process biometric information, as detailed in section b.4 below.
- OpenAI (ChatGPT): processes only text provided by the USER (e.g. descriptions, instructions or preferences) in order to generate recommendations or ideas. The text is processed temporarily and is not retained for other purposes.
- DeepSeek: processes only text provided by the USER (e.g. ideas or descriptions) to generate recommendations or creative proposals. The text is processed in real time and is not retained beyond what is necessary to return the recommendation.
In all cases, the use of data by these providers is regulated by contracts that strictly limit its processing to the provision of the service and expressly prohibit its use for training AI models, commercial, advertising or identification purposes.

a.5) Data retention period
We will only retain your personal data for as long as is strictly necessary to fulfil the purpose of the processing, i.e. for the duration of the contractual relationship for the use of the APPS, and when it is no longer necessary for that purpose, it will be deleted using appropriate security measures to ensure its anonymization or complete destruction.
The data processing described in this section a) applies to all MONKEY TAPS APPS. In certain APPS that incorporate specific hairstyle and beard transformation features, in addition to the provisions set out herein, the additional provisions set out in section b) below, relating to the processing of biometric information, shall apply.
b) Biometric Information
b.1) Use of processed images and biometric data
In addition to the general processing described in section a) and only in MONKEY TAPS APPS that offer hairstyle and beard transformation functions, we may process information that could be considered biometric data, limited exclusively to facial geometric data extracted from the images uploaded by the USER and for the sole purpose of providing the requested SERVICES.
This data includes:
- Facial landmarks: position of eyes, eyebrows, nose, mouth and face contour.
- Vectors and geometric proportions: distances and relationships between these points (e.g., distance between eyes, ratio between forehead and jaw, or shape of chin).
- Basic facial structure: a simplified representation of the oval and orientation of the face, used solely to adjust the overlay of hairstyles or beards.
b.2) Purpose of the use of biometric data
Facial data is used solely to enable the visualization and transformation of hairstyles and beards in images uploaded by the USER. The purpose is strictly aesthetic and recreational: to allow the USER to see how they would look with different hairstyles or beards, without any other additional processing.
Under no circumstances is facial data used to identify, authenticate or recognize the person in the image, nor to train artificial intelligence systems, nor for commercial or advertising purposes.
b.3) Legal basis and conditions of use of biometric data
Biometric information is processed solely on the basis of the USER's explicit and informed consent. Without this consent, we will not carry out the processing and, therefore, the USER will not be able to use the features of the APPS that require facial analysis for the transformation of hairstyles or beards.
When using these features, you will be informed in advance of the processing of your data and only then will the USER who accepts expressly consent to MONKEY TAPS, its subsidiaries and duly authorized service providers collecting, processing and using your biometric information solely for the visualization and transformation of hairstyles and beards, as described in this Privacy Policy.
The USER declares that they have sufficient legal capacity to give this consent. If acting on behalf of a third party, they declare that they have the appropriate legal representation to give such consent on their behalf.
b.4) Third-party AI providers with whom biometric data is shared
In order to provide these functionalities, we use various artificial intelligence (AI) providers. The use of the data shared with them is strictly limited by contract and cannot be extended to any purpose other than those described herein:
- Replicate (Flux-Kontext):
Data processed: facial data extracted from the image (geometric points and basic structure of the face). For example, if the USER uploads a photo to try out a beard style, Replicate only receives the face vectors necessary to apply the AI transformation and return an image with the beard superimposed.
Purpose: to apply AI models that allow hairstyles and beards to be rendered on the image uploaded by the USER.
Facial data retention period: Replicate processes the data in real time and deletes it at the end of the active session. Residual copies may be temporarily retained on backup systems as a technical security measure, but never for any other purpose.
Prohibited uses: Replicate may not use biometric data to train AI models, improve its systems, identify USERS, for commercial or advertising purposes, or for any purpose other than that requested by the USER.Further information: Replicate Privacy Policy.
- OpenAI (ChatGPT):
Data processed: OpenAI will only process text provided by the USER, such as descriptions, instructions, or style preferences. For example, if a USER writes "I want to see a modern hairstyle with three-day stubble," OpenAI processes that phrase to generate a style suggestion, but does not receive photos or facial data.
Purpose: to generate suggestions, recommendations or ideas for hairstyles and beards based on the text written by the USER.
Retention period: the text is processed temporarily to return the response and is not stored permanently for other purposes.
Prohibited uses: OpenAI does not receive or process biometric data or images. It cannot use USERS' text to train or improve its models, or for commercial or advertising purposes.Further information: OpenAI Privacy Policy.
- DeepSeek:
Data processed: DeepSeek will only process text provided by the USER, such as style descriptions or desired combinations. For example, if a USER writes "I want a classic look with a side parting and a trimmed beard", DeepSeek processes that text and returns suggestions for compatible styles, but never receives the image of the face or biometric data.
Purpose: to generate creative recommendations or alternatives for hairstyles and beards based on the textual description provided by the USER.
Retention period: the text is processed temporarily to return the response and is not stored permanently for other purposes.
Prohibited uses: it does not receive or process biometric data or images. It cannot use USER texts to train models, or for commercial, advertising or identification purposes.

b.5) Retention period for biometric data
Facial data is processed in real time and is not permanently stored on MONKEY TAPS' servers. It is automatically deleted after the image transformation is complete, usually within seconds or minutes.
At no time will we store, use or transfer your biometric information outside the device used by the USER to access the SERVICES, except when necessary for the provision of the service itself.
If the USER deletes their account, all processed biometric information will be securely deleted, unless there is a legal obligation in force that prevents us from deleting it immediately (for example, in compliance with a court order or applicable legal procedure).
b.6) Security
All facial data transmissions are encrypted using secure HTTPS protocol. Processing is carried out in isolated and protected environments, inaccessible to unauthorized third parties.
b.7) USER control
The USER may delete uploaded images and associated facial data at any time through the application settings. Upon deletion, the data is permanently erased from both our systems and those of our suppliers.
c) Technical support and customer service
MONKEY TAPS will process the personal data provided by USERS in queries made through the various communication channels available in the APPS in order to provide technical support and respond to their queries related to the APPS.
c.1) Legal basis: MONKEY TAPS' legitimate interest in responding to queries with the highest quality and satisfaction for USERS. For this processing, the corresponding balancing test has been carried out to ensure that our interests do not prevail over the rights and freedoms of USERS.
c.2) Data retention period: We will only retain the data until the query or incident raised has been resolved.
d) Research, information and improvement of the SERVICES
MONKEY TAPS will process the personal data provided by USERS when using the APPS, with the aim of analyzing their performance, detecting incidents, compiling usage statistics and introducing technical and functional improvements to the APPS in order to improve our SERVICES.
This processing is limited to data relating to the use and operation of the APPS and does not involve the processing of biometric information, which is only processed in the specific cases provided for in section b) of this Privacy Policy.
d.1) Personal data processed:
For this purpose, the following data may be processed:
- Technical identifiers of the device and the application.
- APP usage information (e.g. frequency of access, most used sections, operating errors).
- Subscription information.
- Data derived from interaction with the APP's functionalities, processed in an anonymized form whenever possible.
d.2) Legal basis:
MONKEY TAPS' legitimate interest in identifying and resolving problems with the apps and improving the services offered through them. For these processing operations, the corresponding balancing test has been carried out to ensure that our interests do not override the rights and freedoms of users.
d.3) Data retention periods:
The data processed for this purpose will be kept only for the time necessary to carry out the corresponding analysis or improvement and, in any case, in anonymized form whenever possible. Under no circumstances will personal data be kept in a format that allows the USER to be identified for longer than is strictly necessary for the purposes described.
e) Sending of information and commercial communications
Likewise, in the event that MONKEY TAPS wishes to send commercial communications related to the contracted SERVICES, it will inform and obtain the prior consent of the USERS.
e.1) Legal basis: Explicit and informed consent of USERS.
e.2) Data retention periods: The data will be retained until the USER expresses their opposition to the processing through a simple and accessible unsubscribe procedure in each advertising communication or by sending an express request to the email address hello@monkeytaps.app.
f) Administrative and financial management.We will process personal data for administrative, accounting and financial purposes, including issuing invoices, managing collections and payments, as well as possible claims related to the SERVICES provided.
f.1) Legal basis: Pre-contractual, contractual and/or post-contractual execution. In the event that procedures and claims for payment of SERVICES must be carried out, the processing of data will be based on the legitimate interest of defending the rights and interests of the Data Controller.
f.2) Retention period: 6 years from the end of the contractual relationship, in accordance with tax legislation.
All USER information will be treated with absolute confidentiality and all necessary security measures will be taken to safeguard it.
Likewise, MONKEY TAPS informs you that it will only transfer your personal data to companies that are strictly necessary to fulfill the contracting of services, such as banking entities for the payment of services.
Suppliers who need access to the USER's personal data in order to provide the services contracted by MONKEY TAPS, or who, due to the operation of electronic services (applications and email), may have access to certain personal data.
MONKEY TAPS has signed the necessary confidentiality and personal data processing agreements required by law with all of them to protect your privacy.
Likewise, your personal data will be communicated to Public Administrations and other private entities for the purpose of complying with the legal obligations to which MONKEY TAPS is subject by reason of its activities.
Under no circumstances will MONKEY TAPS sell, rent or use the personal data of USERS for purposes other than those provided for herein.
The SERVICES of the APPS and their use are intended for adults. MONKEY TAPS is not responsible for the use of the APPS by minors, the download and use of the APPS being the sole responsibility of the USER.
MONKEY TAPS does not deliberately collect information from minors without the express written authorization of their parents or guardians. Likewise, MONKEY TAPS will use the appropriate technical means to prevent minors from accessing the SERVICES offered in the different applications without the express consent of their parents or guardians.
If MONKEY TAPS detects that a minor is using any of the APPS or SERVICES it offers, it will proceed to cancel the information sent and notify the competent authority or body. To this end, MONKEY TAPS requests the cooperation of all USERS. If you detect the disclosure or use of such data, please notify us via the email address provided so that we can take appropriate action.
MONKEY TAPS processes your Personal Data on servers located outside the EEA, Switzerland and the United Kingdom for the purposes mentioned in this Privacy Policy. This includes the processing and storage of your personal data at our facilities and servers in the United States.
Although data protection laws may vary from country to country and may not provide the same level of data protection as your country of origin, we will apply the protection measures set out in this policy to your personal data, regardless of where the data is processed.
When we transfer personal data outside the EEA, Switzerland or the United Kingdom, we will rely on the following transfer mechanisms to comply with applicable data protection laws:
- We rely on the adequacy decisions of the European Commission, in accordance with Article 45(1) of the GDPR, when transferring your personal data to any country that is considered to provide an adequate level of protection.
- EU-U.S. Data Privacy Framework (DPF), when the provider is located in the US and is duly certified.
- For all other jurisdictions, we rely on the Standard Contractual Clauses (SCC) approved by the European Commission, in accordance with Article 46(2)(c) of the GDPR.

- Data transferred: technical identifiers, usage data, contact details and, in the case of Google Play Store, account and subscription information.
- Purpose: cloud storage, email, metrics and analytics, and distribution of applications through the Play Store.
- Retention period: data is retained for as long as the USER keeps their Google/Play Store account active or until they request its deletion, and in any case only for as long as is necessary to provide the contracted services.

- Data transferred: subscription data, images and results processed by the APP during use of the SERVICES.
- Purpose: cloud infrastructure and backend for the operation of the APPS.
- Retention period: Processed images or files are kept only for as long as necessary to provide the service and are deleted in accordance with the retention periods set out in this Privacy Policy.

- Data transferred: images uploaded by the USER, including those containing facial data in APPS offering hairstyle and beard features.
- Purpose: to process images using AI models to apply visual transformations.
- Retention period: data is processed in real time and deleted at the end of the active session; temporary residual copies may exist in backups for security reasons, which are not used for any other purpose.
- Guarantees: SCCs.
- Replicate Privacy Policy
By accepting our Terms of Use and this Privacy Policy, the USER expressly consents to the international transfers described in this section.
MONKEY TAPS informs data subjects that they have the following rights:
a) Access: allows the data subject to obtain information about whether or not MONKEY TAPS is processing personal data concerning them and, if so, the right to obtain information about the personal data being processed.
b) Rectification: allows errors to be corrected and data that is inaccurate or incomplete to be modified.
c) Erasure: allows personal data to be deleted and no longer processed by MONKEY TAPS, unless there is a legal obligation to retain it and/or other legitimate reasons for its processing by MONKEY TAPS prevail.
d) Restriction: allows the data subject to request that MONKEY TAPS apply measures to the data in question, in order to restrict the processing of the data itself while the accuracy of the data or the legitimacy of its processing is verified; or to prevent its modification or, where appropriate, its deletion or erasure, in order to preserve it as evidence or as a basis for claims.
e) Objection: In certain circumstances and for reasons related to their particular situation, data subjects may object to the processing of their data. MONKEY TAPS will cease to process the data, except for compelling legitimate reasons or for the exercise or defense of possible claims.
f) Portability: allows the data subject to receive their personal data and/or transmit it directly to another data controller in a structured, commonly used and machine-readable format.
The holder of personal rights may exercise their rights of access, rectification, erasure, restriction of processing, objection, portability of their personal data or revoke their consent by writing to MONKEY TAPS at the following email address: hello@monkeytaps.app.

MONKEY TAPS undertakes to adopt the technical and organizational security measures established by law to guarantee the security of the USER's personal data and to prevent its alteration, loss, unauthorized processing or access, taking into account the state of technology, the nature of the data stored and the risks to which it is exposed, all in accordance with the provisions of the applicable regulations.
All transfers of information that the APPS carry out with their own or third-party cloud servers are encrypted and secure through a secure hypertext transfer protocol (HTTPS), which also ensures that the information cannot be intercepted.
In the event that personal data of third parties necessary for the provision of the SERVICES is provided to MONKEY TAPS, the USER declares that they have previously obtained their express consent to transfer it to MONKEY TAPS.
MONKEY TAPS may update this PRIVACY POLICY at any time. An updated version of this PRIVACY POLICY will always be available in the APPS. If these changes affect purposes not provided for in this PRIVACY POLICY, we will inform you sufficiently in advance of such processing through the contact details provided, so that, where appropriate, you may exercise the rights you deem appropriate.
MONKEY TAPS will endeavor at all times to provide SERVICES of the highest quality. Notwithstanding the foregoing, MONKEY TAPS declines any liability and/or assumption of damages arising from failures, interruptions or damages caused by system failures, malicious viruses, interference, disconnections or malfunctioning of the service.
Similarly, MONKEY TAPS declines any responsibility and/or assumption of damages of any nature arising from the unlawful actions of third parties by any means or from the improper or inappropriate use of the APPS by USERS, and, in any case, MONKEY TAPS shall not be liable for any action or negligence unrelated to it that may or may not directly or indirectly affect the servers and other computer equipment of the USER or third parties.
You agree to indemnify and hold harmless MONKEY TAPS, its subsidiaries, affiliates, officers and employees, from any claim or demand, including reasonable attorneys' fees, made by a third party due to or arising from your misuse or unauthorized use of the APPS and/or the SERVICES offered, or your violation of these TERMS AND CONDITIONS, and/or the PRIVACY POLICY, as well as any violation of any law or regulation.
MONKEY TAPS cannot guarantee the absence of viruses or other harmful elements that could affect the USER's equipment; therefore, the USER must take the necessary measures to avoid possible risks of this type, given the current state of telecommunications.
MONKEY TAPS is not responsible for interruptions to the APPS due to force majeure, lack of updating or circumstances beyond its control.
MONKEY TAPS may also temporarily interrupt access for security measures or for reasons of restructuring of IT resources, in order to improve the service of use of the various APPS.
Responsibility for the use of the APPS lies exclusively with the USER. Except as provided in these Terms and Conditions, MONKEY TAPS is not responsible for any loss or damage arising in connection with the download or use of the APPS, such as those resulting from failures, malfunctions or blockages in the operation of the APPS (for example, and without limitation: errors in communication lines, defects in the hardware or software of the APPS or failures in the internet network). Furthermore, MONKEY TAPS shall not be liable for any damage caused by the improper or inappropriate use of the APPS by USERS.
If the USER is not satisfied with the use of the APPS, their content or SERVICES, or with any part of these TERMS AND CONDITIONS and/or the PRIVACY POLICY, the USER's sole and exclusive remedy shall be to cease accessing the APPS and/or using their SERVICES.
If any clause included in these TERMS OF USE AND PRIVACY POLICY is declared totally or partially null and void or ineffective, such nullity or ineffectiveness shall only affect that provision or the part thereof that is null and void or ineffective, and the TERMS OF USE AND PRIVACY POLICY shall remain in force. shall remain in force in all other respects, and such provision, or the part thereof that is affected, shall be deemed not to have been included.
Any issue or dispute that may arise with respect to the APPS, content and SERVICES contracted shall be governed by the applicable regulations and/or jurisdiction, depending on the status of the USER:
In the case of professional USERS and/or entities, both parties submit to the laws and jurisdiction of the State of Florida (United States).
In the case of individual USERS, disputes shall be resolved in accordance with the applicable legislation and jurisdiction of the USER's country.
